E-Bike Laws in San Clemente, California
San Clemente adopted SCMC Chapter 10.62, "Regulation of Electric Bicycles and Other Electric Transportation Devices," introduced unanimously on August 20, 2024. Two provisions are unusual in California. Night riding requires the rider to be at least 16 — an age rule tied to time of day rather than class. And businesses selling or renting e-bikes must distribute copies of the ordinance to customers. E-bikes are banned from the Beach Trail, helmets are locally required, stunts are prohibited on highways, roadways and sidewalks, and parents face joint liability for minors' violations. Older sections reportedly ban Class 3 from the beach and beach trail and cap the beach trail at 10 mph.
SCMC Chapter 10.62 and its exact title are confirmed in the Municode structure for Title 10. But the ordinance number, the section-level breakdown, the fine amounts and the effective date could not be retrieved, and the substance above comes from the San Clemente Times report. The older § 10.08.110 and § 12.32.130 citations come from the OCTA compilation and were not confirmed against the primary code.

Two provisions found nowhere else
The night-riding age rule. San Clemente appears to be the only California jurisdiction that ties
an age requirement to time of day rather than to e-bike class. State law's only age rule is the
Class 3 minimum of 16 (Veh. Code § 21213(a)); the county pilots set class-based age rules for
Marin and San Diego County. A night-riding minimum is a different instrument entirely.
It also raises a question the ordinance may not survive: cities outside Marin and San Diego County generally cannot set e-bike age rules. The City of Santa Cruz discovered exactly this in March 2026 — it adopted a minimum age for Class 1 and Class 2, found it lacked the authority, and is now lobbying the Legislature for it. Whether a time-of-day restriction is distinguishable from an age restriction is untested.
The vendor notice duty. Requiring businesses that sell or rent e-bikes to hand customers a copy
of the ordinance puts the notice burden on the point of sale. Only two comparable requirements were
found: LAMC § 71.31 requires written pre-rental notice in at least 14-point type at Venice Beach,
and Hermosa Beach requires geofencing on rental fleets.
It is a sensible idea. Most riders who violate a local e-bike ordinance have never read one, and the shop is the last point at which anyone can be told.
The beach trail
There are two overlapping sets of rules, and the older one is more specific. SCMC §§ 10.08.110 and
12.32.130, tracking a March 2021 amendment, reportedly ban Class 3 from the beach and beach
trail and cap the beach trail at 10 mph. The 2024 Chapter 10.62 is reported to ban e-bikes
from the Beach Trail generally.
Whether the 2024 chapter superseded, supplemented or coexists with the 2021 rules could not be determined. A rider should assume the Beach Trail is closed to e-bikes.
For coastal comparison: Solana Beach permits Class 1 and 2 on its Coastal Rail Trail and bans Class 3; Santa Monica permits Class 1 and 2 on the Marvin Braude trail and bans Class 3; Orange County Parks permits Class 1 and 2 on 75-plus miles of paved bikeway and prohibits Class 3.
Common questions
Can you ride an e-bike on the San Clemente Beach Trail?
Reporting on SCMC Ch. 10.62 indicates e-bikes are banned from the Beach Trail. Older sections § 10.08.110 and § 12.32.130 are reported to ban Class 3 from the beach and beach trail and to cap the beach trail at 10 mph. How the two sets interact could not be determined, so assume the Beach Trail is closed to e-bikes.
Is there an age limit for riding an e-bike at night in San Clemente?
Reporting on the ordinance indicates night riding requires the rider to be at least 16. This appears to be unique in California — no other jurisdiction surveyed ties an age requirement to time of day. Note that cities outside Marin and San Diego County generally lack authority to set e-bike age rules, a limit the City of Santa Cruz ran into in 2026, so this provision's legal footing is untested.
Do San Clemente e-bike shops have to give you the ordinance?
Reporting on SCMC Ch. 10.62 indicates businesses selling or renting e-bikes must distribute copies of the ordinance to customers. It is an unusual vendor-notice duty — the nearest comparisons are LAMC § 71.31's written pre-rental notice requirement at Venice Beach and Hermosa Beach's rental geofencing mandate.
